Yet another example of how absurd contractor Brian Darnell conducts “business” is shown in the Civil Court records.
Darnell has been regular visitor to the Missouri Courts over four years now, with a string of continuous lawsuits starting May of 2014 Brian Darnell is no stranger to the halls of justice.
Yet for the familiarity he must have with the court houses, getting Mr. Darnell to show up to answer for his conduct is not an easy task for a consumer – Brian Darnell has become adept at avoiding process servers.
We learned how Darnell shirks accountability when we tried to settle our dispute through the Small Claims Court system.
We first sent a summons to Brian Darnell via Registered Mail. The letter needed to be signed for and Darnell the business owner failed to do so. The letter then sat with the Post Office for a month with several notices sent stating that mail was waiting to be picked up. If you listen to News 4 Investigative Reporter Chris Nagus interview Darnell you would think Brian Darnell would have been anxious to have the matter settled before a judge.
This summons letter was addressed to the Registered Agent for Prodigy Restoration Group, which happened to be Brian Darnell himself. (Shortly after our victory in the lawsuit with Darnell the Missouri Secretary of State would close Prodigy Restoration Group on account of Darnell’s failure to perform the required duties of a business’ Registered Agent)
After a month we turned to a Special Process Server to hand deliver the Small Claims Court summons. As the court records above show, the Special Process Server made 5 attempts to deliver the notice to Brian Darnell including his home office in O’Fallon MO but he evaded the person every time that a delivery attempt was made.
The Sheldon Case is demonstrating once again how the owner of Darnell Construction can’t seem to own up to the actions he takes toward customers.
In the Sheldon Case, summons to Darnell was attempted between June and July of 2018 and was unsuccessful. This service appears to be in connection with the efforts underway to hold Brian Darnell personally accountable for his actions, stripping away the LLC protections he has been hiding behind for years.
